Defiant in the face of an international backlash, President Donald Trump pressed into his second week in office defending his sweeping immigration ban — and then fired a Cabinet head who refused to enforce it.
On Monday afternoon, acting Attorney General Sally Yates told her staff not to follow President Trump’s Executive Order on immigration.
January 27, 2017, the President signed an Executive Order regarding immigrants and refugees from certain Muslim-majority countries. The order has now been challenged in a number of jurisdictions. As the Acting Attorney General, it is my ultimate responsibility to determine the position of the Department of Justice in these actions. My role is different from that of the Office of Legal Counsel (OLC), which, through administrations of both parties, has reviewed Executive Orders for form and legality before they are issued. OLC’s review is limited to the narrow question of whether, in OLC’s view, a proposed Executive Order is lawful on its face and properly drafted. Its review does not take account Of statements made by an administration or it surrogates close in time to the issuance Of an Executive Order, that may bear on the order’s purpose. And importantly, it does not address whether any policy choice embodied in an Executive Order is wise or just. Similarly, in litigation, DOJ Civil Division lawyers are charged with advancing reasonable legal arguments that can be made supporting an Executive Order. But my role as leader of this institution is different and broader. My responsibility is to ensure that the position Of the Department Of Justice is not only legally defensible but is informed by our best view Of what the law is after consideration of all the facts. In addition, I am responsible for ensuring that the positions we take in court remain consistent with this institution’s solemn obligation to always seek justice and stand for what is right. At present, I am not convinced that the defense Of the Executive Order is consistent with these responsibilities nor am I convinced that the Executive Order is lawful. Consequently, for as long as I am the Acting Attorney General, the Department Of Justice will not present arguments in defense of the Executive Order, unless and until I become convinced that it is appropriate to do so.

Statement on the Appointment of Dana Boente as Acting Attorney General.
The acting Attorney General, Sally Yates, has betrayed the DOJ by refusing to enforce a legal order designed to protect the citizens of the United States. This order was approved as to form and legality by the Department of Justice Office of Legal Counsel.
Ms. Yates is an Obama Administration appointee who is weak on borders and very weak on illegal immigration.
It is time to get serious about protecting our country. Calling for tougher vetting for individuals traveling from seven dangerous places is not extreme. It is reasonable and necessary to protect our country.
Tonight, President Trump relieved Ms. Yates of her duties and subsequently named Dana Boente, U.S. Attorney for the Eastern District of Virginia, to serve as Acting Attorney General until Senator Jeff Sessions is finally confirmed by the Senate, where he is being wrongly held up by Democrat senators for strictly political reasons.
“I am honored to serve President Trump in this role until Senator Sessions is confirmed. I will defend and enforce the laws of our country to ensure that our people and our nation are protected,” said Dana Boente, Acting Attorney General.
Stephen Miller, the senior policy advisor to Trump, told Tucker Carlson tonight that Yates’ refusal to defend the executive order was a “betrayal of her office.”
“What’s unprecedented here is that the Justice Department would refuse to enforce a lawful federal order for political reasons,” Miller said. “That is dangerous to our constitutional system.”
Miller said that Boente, unlike Yates, will enforce the law and defend Trump’s executive order.
“The core power of the federal government on immigration is its right to deny entry to any alien at any time if it believes that to be in the national interests and national security interests of the United States.”

The executive order that President Donald Trump signed will significantly cut regulations for small businesses’ owners.
President Trump was surrounded by small business owners as he signed the order in the Oval Office this morning. Trump says that the order will attempt to start “cutting regulations massively for small business.” He then stated that it will be the “biggest such act that our country has ever seen.”
White House officials said that the directive was a “one in, two out” plan. It ensures that government agencies who request a new regulation, give two regulations they will cut from their own departments.
The officials who helped insisted on anonymity in order to detail the directive ahead of Monday’s formal announcement.
Officials explained that the new order does not require the repeal of two regulations at the same time as the release of the new additional rules.
It has even been mentioned that certain parts of the regulation will be exempt from this new policy. For example, those dealing with the military and national security. There are also special cases in which the OMB director will also have the ability to waive this policy.
President Trump was the best thing that could have happened to our country, in contrast with Hillary, she was the worst. America had the choice between a criminal and a businessman, we chose the businessman who turned into a politician. Honestly, what more could our in-debt-country ask for? On the campaign trail, he promised to reduce federal regulations that burdened American businesses. Do you think he is already fulfilling his promises? What about this executive order? It makes complete sense that someone who has secured his own financial future would be able to help a country that is drowning in debt.
The immigration ban remained at the forefront of his first fortnight in the White House — and officials were pondering more actions moving forward.
According to a draft document obtained by The Associated Press, Trump is considering an executive order that would target some immigrants for deportation if they become dependent on government assistance.
The draft order calls for the identification and removal “as expeditiously as possible” of any foreigner who takes certain kinds of public welfare benefits. Such immigrants have been barred from the U.S. for the better part of a century and they can already be deported. The proposed order appears to signal a Trump administration effort to crack down on such welfare cases.
Another draft order under consideration would make changes to several of the government’s foreign worker visa programs. The White House did not immediately respond to requests for comments on the draft orders.
White House press secretary Sean Spicer said Trump’s order was “about the safety of America.”
A number of U.S. diplomats also prepared a memo criticizing the order. In a “dissent cable” being drafted for State Department leadership, the diplomats said the ban runs counter to American values and will fuel anti-American sentiment around the world.
The cable originated in the State Department’s Consular Affairs bureau, which handles visas.
Unfazed, Spicer responded that if “career bureaucrats” have a problem with the order, “they should either get with the program or they can go.”
